Digital Millennium Copyright Act Notice and Takedown Procedures

Effective: February 7, 2026

1. Overview

Skootle Web Development ("Skootle") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. Section 512), we have established procedures for receiving and responding to notices of claimed copyright infringement.

If you believe that content on a Skootle-hosted website infringes your copyright, you may submit a DMCA takedown notice following the procedures outlined below.

3. Filing a Takedown Notice

To file a valid DMCA takedown notice, your written notification must include all of the following (per 17 U.S.C. Section 512(c)(3)):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it (specific URLs)
  4. Your contact information (name, address, telephone number, email)
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

Incomplete notices may not be processed. All six elements above are required by law.

4. Counter-Notification

If you believe your content was removed in error, you may file a counter-notification. Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed and the location at which it appeared before removal
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in Richmond, Virginia, and that you will accept service of process from the person who provided the original takedown notice

5. Our Process

Upon receiving a valid takedown notice:

  1. We will promptly remove or disable access to the allegedly infringing content
  2. We will notify the content owner (tenant) of the takedown
  3. The content owner may submit a counter-notification

Upon receiving a valid counter-notification:

  1. We will forward the counter-notice to the original claimant
  2. The claimant has 14 business days to file a court action seeking an injunction
  3. If no court action is filed within 14 business days, we will reinstate the removed content

6. Repeat Infringers

Skootle will terminate the accounts of users who are repeat infringers in appropriate circumstances. We consider the following when evaluating repeat infringer status:

  • Number of valid DMCA notices received
  • Whether counter-notices were filed and sustained
  • The severity and nature of the infringement
  • Whether the user took steps to prevent further infringement

7. Good Faith Requirement

The DMCA requires that takedown notices be made in good faith. Filing a false DMCA notice may result in liability for damages under 17 U.S.C. Section 512(f), including costs and attorney fees.

We encourage copyright owners to consider whether the allegedly infringing use might constitute fair use before filing a takedown notice.
